Most terms of service exist to protect companies, not to inform customers. These terms exist to do both — clearly, in the same voice we use everywhere else. If something is unclear, email us. We are not hiding behind language.
CHOIVE is an AI selection diagnostic platform. It analyses how likely AI systems — ChatGPT, Perplexity, Gemini, Claude — are to recommend your business when a potential customer asks for one. It scores your current position, identifies who AI recommends instead of you, and tells you exactly what to fix.
AI recommendation behaviour is determined by the AI platforms themselves. CHOIVE analyses the signals that influence that behaviour — it does not control it. No diagnostic tool can guarantee how any AI platform will respond to any specific query on any given day.
All payments are processed by Stripe. When you pay for an Analysis or Report, you are paying Stripe — CHOIVE never sees, stores, or has access to your card details at any point.
Payment is due at the time of purchase. Access to your paid result or Report is granted immediately upon Stripe confirming payment — there is no delay, no manual approval, no waiting period.
All prices are in USD. CHOIVE does not currently charge VAT or GST separately — the price shown is the price you pay.
No card on file. After a purchase, CHOIVE holds no payment information about you. If you run a new diagnostic and want to unlock it, you enter payment details fresh via Stripe each time. There is no stored card, no auto-renewal, and no way for CHOIVE to charge you again without a new deliberate action on your part.
Every CHOIVE diagnostic runs real-time — live search queries, live website inspection, live AI simulation. The moment you pay, that work has happened. This is why our general position is that payments are non-refundable.
But we stand behind what we build. Here is exactly when refunds apply and when they do not:

CHOIVE generates diagnostic results using live data — search signals, website inspection, citation checking, and AI simulation — at the exact moment you run the diagnostic. Those signals change constantly. A result from Monday may differ from one run on Friday. That is not a defect. It is the product accurately reflecting a live and shifting environment.
Your result is a snapshot, not a permanent judgement. AI recommendation behaviour across ChatGPT, Perplexity, Gemini, and Claude shifts as those platforms update their models, change their training data, and adjust their response behaviour. CHOIVE measures your position at a point in time. It cannot predict how those platforms will behave tomorrow.
On score variation between runs. Running the same diagnostic twice in 24 hours may produce slightly different scores. This is expected and correct — it means the signals CHOIVE is measuring are genuinely live. A score that never changes regardless of what you do would be the lie. CHOIVE does not lie.
CHOIVE is not professional advice. Nothing in your diagnostic result constitutes legal, financial, marketing, or professional advisory guidance. It is an AI-generated analysis of observable signals. Act on it with the same judgement you would apply to any business intelligence tool.
CHOIVE is built for businesses to understand and improve their AI selection position. Use it for that. The following will result in immediate termination of access, and in serious cases, legal action:
Reasonable and legitimate use — running diagnostics on your own business, sharing results with your team or agency, purchasing reports for internal strategy, citing your CHOIVE score in marketing materials — is entirely permitted and encouraged.
What belongs to CHOIVE: The CHOIVE platform, the CHOIVE Index™ scoring methodology, the diagnostic engine, the prompt architecture, the output structure, the CHOIVE Analysis™, and the CHOIVE Report™ are proprietary. The brand, the design system, and all generated content produced by the CHOIVE engine are owned by CHOIVE.
What belongs to you: The business information you provide. You own your data. CHOIVE uses it to run your diagnostic and for nothing else.
What you are licensed to do with your result: When you purchase an Analysis or Report, you receive a personal, non-exclusive, non-transferable licence to use that result for your own business purposes. You can share it internally, show it to your agency, include it in board presentations, and cite your score in marketing. You cannot resell it, rebrand it, or present it as your own original analysis.
On citing your CHOIVE score publicly. You are welcome to share your score, your competitor name, and your result. If you do, please represent it accurately — including the date it was run, since scores change with market conditions.
CHOIVE is responsible for delivering the product you paid for. If your Analysis fails to load or your Report fails to arrive, that is on us and we fix it. That is where our direct responsibility is clear.
What CHOIVE is not liable for: We are not liable for indirect, consequential, or lost-profit damages arising from your use of CHOIVE results. This means: if you act on a CHOIVE recommendation, implement the suggested changes, and your AI selection position does not improve — we are not liable for that outcome. AI platform behaviour is outside our control.
The cap. CHOIVE's total liability to you for any claim arising from use of the service is limited to the amount you paid for the specific product involved in the claim. If you paid $99 for an Analysis, our maximum liability related to that Analysis is $99.
What this cap does not cover. Nothing here limits our liability for fraud, deliberate misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot legally be excluded or limited. If we do something genuinely wrong, we are accountable for it.
This limitation exists not to escape responsibility for failures, but to accurately describe what CHOIVE can and cannot control. A diagnostic tool does not guarantee outcomes. Neither do we.
CHOIVE is a global product. Our legal entity is being formalised in the United Arab Emirates. These terms are governed by UAE law to the extent our entity is registered there, and otherwise by the laws of the jurisdiction where CHOIVE's primary operations are based at the time of any dispute.
Before anything formal happens. If you have a dispute with CHOIVE — about a charge, a result, a decision, anything — the first step is an email to hello@choive.com. We would rather resolve it in 48 hours than spend months in a legal process that serves neither party.
If a dispute cannot be resolved informally, both parties agree to attempt mediation before initiating formal legal proceedings. This is not a legal requirement — it is the reasonable thing to do and we commit to it in good faith.
How CHOIVE collects, uses, stores, and protects your data is covered in the Privacy Policy — a separate document written with the same level of honesty and specificity as these terms.
The privacy policy is incorporated into these terms. Using CHOIVE means accepting both documents. If there is a conflict between what the privacy policy says and what these terms say about data, the privacy policy governs.
The privacy policy covers: what data we collect and why, every third-party service that touches your data, international transfer mechanisms, specific retention periods, your rights, automated decision-making disclosure, and CCPA rights for California residents.
The date at the top of this page changes whenever these terms change. For material changes — anything that meaningfully affects your rights or obligations as a CHOIVE user — we announce it on the CHOIVE homepage for at least 14 days before it takes effect.
Previous versions of these terms are available on request by emailing hello@choive.com. We do not apply changes retroactively to purchases made before the change took effect.
Using CHOIVE after a material change takes effect means you accept the updated terms. If a change is not acceptable to you, stop using the service before the effective date. If you have an active paid result, your access to that result is not affected by declining future terms.
You must be at least 18 years old to use CHOIVE, create an account, or make a purchase. CHOIVE is a professional business tool. It is not designed for, directed at, or appropriate for anyone under 18.
By using CHOIVE, you confirm that you are at least 18 years old and have the legal capacity to enter into a binding agreement in your jurisdiction.
If a purchase is made by or on behalf of someone under 18, contact us at hello@choive.com immediately. We will cancel the purchase, issue a full refund, and delete all associated data.
If something in here is unclear, if a situation is not covered, or if something does not feel fair — email us directly. We are not hiding behind legal language and we will not route your question to a ticket system.
